These Terms and Conditions ("Terms") govern your access to and use of Zigment.ai's website, products, and services (collectively, the "Services") operated by Zigment Technologies Pvt Ltd ("Zigment", "we", "us", or "our"). Please read these Terms carefully before using our Services.

4. Intellectual Property
4.1 Zigment's Intellectual Property
The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Zigment, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
4.2 License to Use Services
Subject to these Terms, Zigment grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal or internal business purposes.
4.3 User Content
You retain any copyright and other proprietary rights that you may hold in the Content that you submit, post, or display on or through the Services. By submitting, posting, or displaying Content on or through the Services, you grant Zigment a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Content.
5. AI and Data Usage
5.1 AI Models and Training
Our Services utilize AI models from various third-party vendors. By using our Services, you acknowledge and agree that:
a) We may use your data to train and improve our AI models. b) Your interactions with our AI agents may be processed by these third-party AI services. c) Anonymized and aggregated data from your interactions may be used to enhance our AI capabilities.
5.2 Data Processing
All data processing activities carried out as part of the Services will be governed by our Privacy Policy, which is incorporated by reference into these Terms.
6. Third-Party Links and Services
The Services may contain links to third-party websites or services that are not owned or controlled by Zigment. Zigment has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. 7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ZIGMENT DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
IN NO EVENT SHALL ZIGMENT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; c) ANY CONTENT OBTAINED FROM THE SERVICES; AND d) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT,
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
9. Indemnification
You agree to defend, indemnify, and hold harmless Zigment, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
10. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of Karnataka, India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
